As many of our clients who are farmers know, Syngenta and the litigation surrounding it have been in the news recently. Below are some of the latest developments:

  • On August 17, Syngenta's claims against ADM, Bunge, Cargill, Louis Dreyfus, and Gavilon were all dismissed. This also led to the dismissal of some of the farmer-plaintiff claims against Syngenta. However, the main claim of negligent commercialization of MIR 162 survives.
  • In Kansas, a group is seeking to class certify several claims against Syngenta, but this litigation has been repeatedly delayed. We will keep an eye on these proceedings, and as soon as a ruling is made on class certification all clients will be provided a formal, written update.
